Q: Someone dyed my wool a color I don’t want. Although he enhanced the wool, can I claim that he’s welcome to remove his dye and refuse to pay him?
A: Some maintain that even according to the opinion that the owner can claim, “Remove your enhancement” also for property fit for enhancement — where it is not possible to remove the enhancement and it benefitted the owner — he is obligated to pay. For example, if the enhancer plowed a field fit for planting, or dyed wool without being asked, where the plowing or dye cannot be “removed,” the owner is obligated to pay (Nesivos 306:7; 375:2; see Chazon Ish B.K. 22:6).
However, if the owner truly has no benefit from the enhancement, he is not liable (Chazon Ish, B.B. 2:6).
Others write that even if the enhancement cannot be removed, the owner can claim that he does not want it, and cannot be forced to pay (Ketzos 306:6).
