The Gevuras Ari (Ta’anis 17a) asks on Rebbi from the Mishnah in Succah which teaches that R’ Yochanan ben Zakai made a special takonah and forbade eating chodosh the entire 16th of Nissan due to ק״ מהרה יבנה בהמ – “the speedy rebuilding of the Beis HaMikdosh”. In regard to the prohibition of eating chodosh, the worry is very small, and it would only be for one year, yet we are worried, so why is Rebbi not concerned? It’s true it has been many years, but so what?
Because of this question, the Gevuras Ari concludes that the Gemara in Succah doesn’t go like Rebbi. Rebbi agrees to the din of R’ Yochanan ben Zakai but for an entirely different reason. Rebbi holds like R’ Yehudah, who learns that sunrise (האיר מזרח) doesn’t permit the prohibition of chodosh and when the Torah says: עד עצם היום הזה – “(chodosh is prohibited) until the arrival of the day”, עד ועד בכלל – “it’s inclusive and it means until the 17th of Nissan”.
