The Power of Bizyonos and Torah’s Rachmanus

We find a difference between a Ganav who steals a sheep, and one who steals an ox. One who steals an ox (and Shechts or sells it) pays back 5 times the amount. But for a sheep, he only pays back 4. Chazal explain, that by a sheep, the thief suffered a Bizayon while carrying it, which counts as if he paid one sheep. Imagine the power of Bizyonos! Even if it’s his own fault, and even though he had Bizyonos while being engaged in a sin! There is a rule in the Torah called: קָ ם לֵ יהּ בָ רַ דְ בְ ה מִ ינֵ יהּ. This means that if a person does two Aveiros simultaneously, where one is Chayav Missa (death), and the other is Chayav Tashlumin (money), he only gets the greater punishment (Missa) and is Patur (exempt) on the money.

The reasoning is that it’s enough that they are killing him, so he’s Patur on the money issue (see RSRH). Bizyonos is similar to death (Gemara) and Chazal say it is better to throw yourself into a fiery furnace than to embarrass a person (like Tamar with Yehuda). Perhaps the reason why the Ganav pays only 4 sheep is because he has Bizyonos which is like a partial death. Therefore, the Torah has Rachmanus on him, like someone who is a Chayav Missa, and he becomes Patur on a part of the money.

It is unbelievable how much Rachmanus the Torah has even for Reshaim! And even people whom they themselves caused their own pain and Tzaros because they are so negative or some other reason; still the Torah has Rachmanus on them since they suffered! And especially Bizayon is a Gevaldige Tikkun and Kapara!
